These Terms of Service (“Terms”) govern your use of the TourReach website at tourreach.com and any services provided by TourReach (“we,” “our,” or “us”). By accessing our website or engaging our services, you agree to be bound by these Terms.

TourReach operates under the ReachMax Digital Network and is based in Jamaica.

1. Who These Terms Apply To

These Terms apply to:

Visitors to the tourreach.com website
Clients who engage TourReach for any service, including website development, digital marketing, Voice AI, Google Business Optimization, TripAdvisor Review Growth, Viator Supplier Optimization, content marketing, and direct booking system setup
Any individual or business that communicates with TourReach for the purpose of exploring or receiving services

2. Our Services

TourReach provides digital marketing and business infrastructure services to tour drivers, tour operators, and tourism businesses. Our services include but are not limited to:

Website design and development
Voice AI Agent setup and management
Direct booking system installation
Google Business Profile optimization
TripAdvisor review growth and profile management
Viator supplier listing optimization
Content marketing and digital visibility strategy
Digital campaign support

The specific scope, deliverables, timeline, and pricing for each engagement will be agreed upon in writing prior to the commencement of any work. Nothing in these Terms constitutes a guarantee of specific results, rankings, bookings, or revenue outcomes.

3. Client Responsibilities

By engaging TourReach, you agree to:

Provide accurate, complete, and up-to-date information about your business when requested
Grant TourReach necessary access to platforms, accounts, and tools required to deliver the agreed services — including but not limited to Google Business Profile, TripAdvisor, Viator, website hosting, and domain management
Review and approve deliverables within the agreed timeframes
Communicate openly and respond to requests from our team in a timely manner
Ensure that any content, images, or materials you provide to TourReach do not infringe on third-party intellectual property rights
Comply with the terms and conditions of any third-party platforms connected to your services

Delays caused by failure to meet these responsibilities may affect project timelines, and TourReach will not be held liable for resulting delays.

4. Payments & Fees

Pricing for all services will be agreed upon in writing before work begins
Payment terms, including deposit requirements and payment schedules, will be outlined in your service agreement
All fees are due in accordance with the agreed payment schedule
Late payments may result in a pause or suspension of active services until the outstanding balance is settled
TourReach reserves the right to adjust pricing for ongoing services with reasonable notice
All fees are non-refundable unless otherwise stated in your individual service agreement

5. Intellectual Property

Our Work

All websites, designs, copy, strategies, systems, and other deliverables created by TourReach remain the intellectual property of TourReach until full payment has been received. Upon receipt of full payment, ownership of agreed deliverables transfers to the client, unless otherwise specified in the service agreement.

Your Materials

Any content, logos, images, or materials you provide to TourReach remain your property. By providing these materials, you grant TourReach a non-exclusive licence to use them solely for the purpose of delivering your services.

TourReach Brand Assets

You may not use TourReach’s name, logo, or brand assets without prior written consent.

6. Third-Party Platforms

TourReach works with and on behalf of clients across a number of third-party platforms including Google, TripAdvisor, Viator, Meta, and others. Please note:

TourReach is not affiliated with, endorsed by, or officially partnered with any of these platforms
We do not guarantee that actions taken on third-party platforms will result in specific outcomes, as platform algorithms, policies, and ranking systems are outside our control
Each third-party platform has its own terms of service, which you remain responsible for complying with
TourReach is not liable for any changes made by third-party platforms that affect your listings, rankings, or account standing

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes business strategies, pricing, client data, and any materials marked as confidential.

This obligation of confidentiality does not apply to information that is publicly available, independently known by either party, or required to be disclosed by law.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

TourReach does not guarantee specific results, including but not limited to search rankings, booking volume, revenue increases, or platform performance
TourReach shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or website
Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to TourReach in the three months preceding the claim

Nothing in these Terms limits liability for fraud, gross negligence, or any matter that cannot be excluded by law.

9. Warranties & Disclaimers

TourReach provides its website and services on an “as is” and “as available” basis. We make no warranties, express or implied, regarding:

The uninterrupted or error-free operation of our website
The accuracy or completeness of any information on our website
The fitness of our services for any particular purpose beyond what is expressly agreed in writing

10. Termination

By the Client

You may terminate a service engagement by providing written notice in accordance with the terms of your individual service agreement. Any fees due up to the date of termination remain payable.

By TourReach

TourReach reserves the right to suspend or terminate services with written notice if:

Payment obligations are not met
You breach any provision of these Terms or your service agreement
Continuing the engagement would require TourReach to act unlawfully or unethically

Upon termination, TourReach will return any client-owned materials and transfer any applicable deliverables for which full payment has been received.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Jamaica. Any disputes arising from these Terms or your engagement with TourReach shall be subject to the jurisdiction of the courts of Jamaica.

If you are located outside Jamaica, local laws may also apply. Nothing in these Terms overrides any rights you have under the consumer protection laws of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements. When we do, we will update the “Last Updated” date at the top of this page.

Continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

13. Entire Agreement

These Terms, together with any individual service agreement entered into between you and TourReach, constitute the entire agreement between the parties with respect to your use of our services. They supersede any prior discussions, representations, or agreements.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
